Submitting Content to ARH Music does not transfer ownership of your copyrights unless otherwise agreed in writing.
3. User Representations
By submitting Content, you represent and warrant that:
- You own or control all necessary rights.
- Your Content does not infringe any copyright, trademark, publicity, privacy, or other legal rights.
- All required licenses and permissions have been obtained.
- The submitted metadata is accurate and complete.
- Distribution of the Content complies with applicable law and DSP policies.
4. Copyright Infringement Notices
If you believe that Content distributed through ARH Music infringes your copyright, you may submit a written copyright complaint containing:
- Your full legal name;
- Contact information;
- Identification of the copyrighted work;
- Identification of the allegedly infringing Content;
- A statement that you have a good-faith belief that the use is unauthorized;
- A statement that the information provided is accurate; and
- Your physical or electronic signature.
Incomplete notices may delay processing.
5. Review Process
Upon receiving a valid complaint, ARH Music may:
- Request additional information;
- Contact the parties involved;
- Temporarily suspend the affected Content;
- Hold related royalty payments where appropriate;
- Remove or disable access to Content where required by law or platform policy; or
- Reject complaints that appear incomplete, unsupported, or abusive.
Submission of a complaint does not guarantee removal of Content.
6. Counter Notification
If your Content has been removed or disabled as a result of a copyright complaint and you believe the removal was made in error, you may submit a counter-notification containing sufficient information to support your claim.
ARH Music may forward a valid counter-notification to the complaining party where appropriate and may restore the Content if permitted by applicable law and platform policies.
7. Ownership Disputes
Where multiple parties claim ownership of the same Content, ARH Music may request documentation such as:
- Copyright registrations;
- License agreements;
- Publishing agreements;
- Split sheets;
- Recording agreements;
- Court orders; or
- Other evidence reasonably necessary to verify ownership.
Until the dispute is resolved, ARH Music may suspend distribution or place related royalty payments on hold.
8. Trademark Complaints
ARH Music may also investigate complaints relating to trademarks, trade names, logos, artist names, or branding.
Users must ensure that submitted Content does not unlawfully use or infringe the intellectual property rights of others.
9. Repeat Infringer Policy
ARH Music reserves the right to suspend or terminate accounts that repeatedly submit Content found to infringe intellectual property rights or repeatedly violate this Policy.
Repeated violations may result in:
- Removal of Content;
- Suspension of distribution services;
- Account suspension;
- Permanent termination of the Account; and
- Restriction from using ARH Music Services in the future.
10. False or Fraudulent Claims
Knowingly submitting false, misleading, fraudulent, or abusive copyright complaints or counter-notifications may result in:
- Rejection of the claim;
- Suspension of account privileges;
- Termination of Services; and
- Other actions permitted under applicable law.
Users remain responsible for the accuracy of any information submitted.
11. Cooperation with Authorities
ARH Music may cooperate with courts, government authorities, law enforcement agencies, Digital Service Providers (DSPs), payment providers, and rights holders where required by applicable law or a valid legal request.
12. Limitation of Responsibility
ARH Music acts as a technology and distribution service provider.
Except as required by applicable law, ARH Music does not independently verify ownership of every work submitted and relies on the representations, warranties, and documentation provided by users.
Nothing in this Policy limits any legal obligations imposed on ARH Music by applicable law.
13. Policy Updates
ARH Music may modify this Policy from time to time to reflect changes in applicable laws, industry standards, or operational practices.
The latest version will be published on the ARH Music website together with the updated “Last Updated” date.
